On August 19, 2026, Mr. Prasert Jantararuangtong, Minister of Education, spoke regarding the case of 13 children at the Mae La Temporary Shelter for Displaced Persons in Tha Song Yang District, Tak Province. The children were ordered to suspend their studies at Khane Chue School in Mae Ramat District after Tak Primary Educational Service Area Office (PESAO) Area 2 deemed their legal status non-compliant with prescribed laws. He acknowledged that the issue originated along the Tak border and clarified that Thailand strictly adheres to various international treaties and declarations made with global organisations.<\/p>\n\n\n\n\n\n\n\n

Mr. Prasert stated that he fully understands that all children residing in Thailand\u2014whether holding Thai nationality or non-Thai status\u2014are entitled to education anywhere in the world according to international declarations. However, given the existence of the temporary shelter, the Ministry of Education must arrange education within the camp. Therefore, the management plan will be divided into two phases:<\/p>\n\n\n\n

Phase 1 (Short-term resolution): Finding immediate methods to provide education inside the shelter to ensure convenient access for all children.<\/p>\n\n\n\n

Phase 2 (Long-term resolution): Reviewing relevant legislation. If the law explicitly prohibits education outside the shelter, the ministry will explore options for flexibility that align with both budgetary frameworks and international declarations\/conventions, ensuring an appropriate legal approach. This necessitates multi-agency consultations, though initial short-term efforts will focus on implementing instruction within the shelter.<\/p>\n\n\n\n

In a subsequent telephone interview regarding the 13 children who have been out of school for 13 days, Mr. Prasert added that discussions on August 31 will bring together all relevant sectors to track the status of these students. He emphasized that he understands the situation well and that the Ministry of Education typically permits all children to study. However, when auditing bodies such as the State Audit Office (SAO) or the National Anti-Corruption Commission (NACC) raise observations on certain points, the ministry must carefully identify appropriate legal channels to render assistance.<\/p>\n\n\n\n

Dr. Bongkot Napaumporn, an academic expert in human rights law, expressed her agreement and support for the Ministry of Education\u2019s commitment to the “Education for All” principle, which aligns with Thailand\u2019s international human rights obligations reaffirmed on the global stage. However, she cautioned that if progress on protecting the rights of these excluded children stalls, Thailand will undoubtedly face criticism from the international community during the Universal Periodic Review (UPR) process later this year, negatively impacting the country’s image. She asserted that the Ministry of Education is the primary agency responsible for making decisions on educational provision, as it falls directly under its core mandate.<\/p>\n\n\n\n

“I believe every agency is well aware that an uneducated population inevitably impacts national security,” Dr. Bongkot noted. “Observing recent security policy trends since August 2025, there has been a clear shift from pure containment and welfare toward skill development, enabling displaced persons to become self-reliant. Therefore, providing suitable education for displaced children naturally aligns with the security sector’s policy direction.”<\/p>\n\n\n\n

Dr. Bongkot clarified that she is not demanding that all displaced children enter Thai public schools, but rather urging the Ministry of Education to provide suitable education\u2014whether inside or outside the camps. She welcomed the Education Minister’s statement that the government is actively considering educational arrangements for children inside the shelters.<\/p>\n\n\n\n
